I've just been in an auto accident. What should I do first?

Being in an auto accident is a very serious and sometimes deadly event. Accidents that may, a first, appear to be minor, often can cause debilitating injuries that will continue to affect the quality of your daily life. Car accidents and injuries of ANY kind should not be taken lightly. Here’s what you should do:

First and foremost call 911, report the accident and wait for the police to arrive. Get to a nearby hospital if you are hurt. If you, or someone else, cannot drive to the hospital, ask the 911 operators for medical assistance and an ambulance will take you to the emergency room. If you do not feel you are hurt to the point of needing to go to the hospital or to be treated by emergency personnel, then get the “Driver’s Exchange of Information Sheet” from the investigating officer once he/she has completed their investigation.

Second, PICTURES, PICTURES, PICTURES!! It has been said that a picture is worth a thousand words. Eliminate the need for in depth and repetitive descriptions of the accident and take as many pictures as you can. Take pictures of your car, the at-fault drivers car, any other cars involved in the accident. Take pictures of the road where it happened. Take pictures of you and your injuries, your passengers’ injuries, and the at-fault driver and their passengers. Lastly, take pictures of any damage to street signs, street lights, or other property. You can never have too many pictures of your accident scene, injuries and damage.

My insurance company's attorney called me. Do they represent me?

Yes and No. Your auto insurance carrier will be paying for your medical treatment so it is imperative that you cooperate with them in order to get your treating doctor paid. However, under no circumstances should you submit to a “recorded statement” for ANY insurance company. Politely decline a recorded statement if asked to do so. There is no reason to be rude, the insurance company is just trying to do their job. However, what you say immediately after a car crash as to how you feel, what injuries you have (if any), and if you need any emergency medical treatment could very well change within 48-72 hours. Most insurance companies will use a recorded statement against you to potentially deny medical coverage. How long will it take before I get a settlement in my case?

That’s a tough question. Some cases settle very quickly because injuries are minor, and your recovery is fast. How long will it take before I get a settlement in my case?

If you are severely injured, first call 911 and get transported to the nearest hospital by ambulance. If you do not need IMMEDIATE medical attention make sure you report the accident to management. Before leaving the business, you should take pictures of the ENTIRE area not just the area where you tripped and fell. If you slipped on a slick surface, try to figure out what caused the floor to be slippery. Was the floor greasy, soapy, wet, did it have an odor? Was it soda, coffee, water, mop water?
